UDRP: filing a notice of opposition
Has someone else registered your brand name? In that case you can file a notice of opposition according to the UDRP.
  What is the UDRP?

UDRP stands for ‘Uniform Domain Name Dispute Resolution Policy’. Through the UDRP, you have the possibility to claim a domain name that has been registered by someone else and that violates your rights to the brand without having to resort to legal action.

This alternative dispute resolution policy you can appeal to is characterized by its exceptional speed and by the fact that the procedure happens online with no need for the parties to have to appear before court (in principle). The decision of the UDRP commission is communicated to the .ASIA registry and to both parties, who, in turn, may react to the decision.

Who can request a UDRP procedure?

A UDRP procedure can be launched by:

  • Every person/company that believes to have more right to a domain name that has already been applied for.
  • When does one speak of an opposition?

    When a domain name is identical to or is used in a confusing way with regard to a name to which certain rights have been attributed, like e.g. a brand name, a trade mark, a company name, etc.

    But also when the domain name has been registered without any rights or justifiable claim or if the domain name has been registered and used with evil intentions, one can speak of an opposition.

    What happens after the UDRP procedure?

    If the opposition is rejected, the domain name remains the property of the current owner.
    If the opposition is accepted by the UDRP commission, the validation starts with the following candidate on the waiting list.

    How much does it cost to launch a UDRP procedure?

    The launching price of a UDRP procedure isn’t known yet, but what is certain is that the fee is to be paid by the plaintive at the beginning of the procedure. The fee cannot be refunded if the claim is deemed unfounded or if a negative ruling is given to the plaintive.
