
Everyone who possesses a brand name can submit a file during the Sunrise periods 2 and 3 and it is indeed possible that an Australian company incidentally has the same name as a Belgian company. If both have submitted a file during the .ASIA Sunrise period, a solution must be found in order to take a decision.
The dotAsia organisation has decided to approach this problem by holding an auction for each domain name with multiple requests. This means that the order of arrival of the requests during the Sunrise period isn’t relevant at all. The dotAsia organisation will meticulously control each file and when they think that you are eligible to claim the involved domain name, you’re informed about it. In this event, 2 scenarios are possible:
- 1. You’re the only one who has submitted a request for the involved domain name during the Sunrise period. Once your file has been validated, your domain name is registered at COMBELL.
- 2. Two or more files have been submitted involving the same domain name: you will receive information regarding the other interested parties and regarding the auction of the domain name itself.
The following procedure is followed:
- All files for the domain name are controlled.
- All validated requesting parties receive information about the other requesting parties that claim the domain name.
- If you think that some requesting parties should not have the right to claim the involved domain name, you can notify dotAsia about it before the auction. In this event, the defendant must prove to dotAsia and the plaintiff that he does have the right to claim the domain name.
- When all requesting parties consider each other as rightful bidders, dotAsia starts informing the parties about the actual auction for the domain name. This will very probably be conducted in a completely electronic manner, although the details pertaining to this matter haven’t been announced yet.
- The domain name is attributed to the highest bidder and after that, if you started a Sunrise procedure through COMBELL, the domain name is registered for the desired period at COMBELL.
Good to know:
- Should you decide to withdraw before the auction, thus renouncing your desired domain name, this is possible and causes no problem. In case you were competing with only 1 other requesting party, the domain name automatically goes to the other party without having to hold an auction.
Caution: the application fees are not refunded by COMBELL.
- When the auction is held and no requesting party places a bid, the domain name is free to apply for again (after expiration of the allotted time) and can thus be registered by anyone.
- COMBELL is not responsible for bidding and the costs for bidding against other parties for your domain name.
